TERMS AND CONDITIONS FOR GOLFERS

These terms and conditions are applicable to the booking process between the golfer and Hole19 (Stat Track Technologies - Serviços Tecnológicos Para o Desporto, Lda, NIPC 509866077, with registered domicile at Largo dos Colegiais, nº 2, 7004-516 Évora) as a booking platform.

1. BOOKING

A golfer may create a booking at any of the golf courses available on the Hole19 platform based on the availability and prices that are in the system. The booking can be made either through Hole19’s website or through its mobile applications. In some cases, the golfer will be informed that the booking will be made through a partner of Hole19. In such cases, the partner will be perfectly identified and a link to such partner’s terms and conditions will be provided as those will be the terms and conditions applicable to such booking.

When a golfer books a tee-time through Hole19, he will be required to make a partial payment that is collected by Hole19 on behalf of the golf course as a guarantee to secure the booking for the golfer. When the golfer pays the green fee at the golf course, this guarantee is automatically transformed in partial payment and considered received by the golf course. The golfer will be solicited to pay the golf course only for the remainder between the value of the green fee and the amount already paid to Hole19 (excluding booking fees).

2. BOOKING FEES

When making a booking on Hole19, the golfer may pay a service charge. The golfer recognises that this fee is non-refundable - even in the event of a cancellation.

3. CANCELLATIONS

Any booking made through Hole19 may only be cancelled by the golfer according to the information supplied in the booking page and in the confirmation email (local time applicable).
In order to cancel a booking, the golfer needs to use the unique URL that is provided in the confirmation email for the booking. The golfer recognises that any other method of cancellation such as emailing Hole19 or contacting the course directly is not valid and may impede Hole19 from being able to refund the value paid by the golfer, due to the terms and conditions of the agreement between Hole19 and the course.
Any attempt at cancellation made after the period indicated in the booking page and confirmation email, will be invalid, and as such any value paid for the tee-time will not be refundable.
In the event of a invalid cancellation or a no-show, the golfer irrevocably authorizes Hole19 to retain the guarantee constituted at the time of booking and to charge the mean of payment used at such time for the remainder value of the green fee, as Hole19 is contractually obliged with the golf courses to indemnify them of the no-shows.

4. BOOKING CONFIRMATION

The golf course will be required to honour any and all reservations that come from Hole19 as he would from any other source, and should not solicit from the golfer any extra fees or payments that would not be charged to other golfers, excluding any amounts owed for the green fee, namely the remainder between its value and the amount already paid by the golfer to Hole19 (excluding booking fees). This doesn’t apply to any extra services that the golfer might want to incur (food and beverage, equipment rental, buggy, etc.)

5. BAD WEATHER POLICY

The golfer agrees to abide by the golf course’s bad weather policy and recognises that any issues caused by bad weather should be resolved between them and the course. In such cases, it will be up to the golfer and the golf course to find suitable compensation or replacement, either by the course providing a full or partial refund, or through rescheduling, as they would if the golfer had not booked via Hole19. Hole19 cannot be held responsible for any issues caused by bad weather.

6. PRICING ERRORS

In the event of a pricing error detected on the website, Hole19 reserves the right to cancel a golfer’s booking and refund the price paid, along with any fees.

In the event of an availability error detected on the website, Hole19 reserves the right to cancel a golfer’s booking and refund the price paid, along with any fees.

8. ACCURACY OF INFORMATION AND COURSE POLICIES

General information about the golf courses advertised on our site are provided to us by the golf courses. Whilst we try to ensure that this information is correct and up-to-date by regularly contacting the courses, we rely on the golf courses providing us with accurate information. Accordingly, we do not accept any liability whatsoever to you in respect of any inaccurate or erroneous information provided, except to the extent caused by our negligence or fraud.
The golfer recognises that the golf course can have certain policies and/or a code of conduct and agrees to abide by them as much as possible. Hole19 cannot be held responsible by any issues arising from the golfer not following the course’s rules of conduct. These can include but are not limited to: handicap requirements, dress code, code of conduct.
Hole19 will do its best to include any and all rules and codes of conduct relative to a particular course, but the golfer should always check the course’s website or call the course before his reservation in order to confirm that he or she is aware of and fulfils all the requirements to play at the chosen course.

9. OUR LIABILITY

As agent for the sale of tee time bookings on behalf of the golf courses listed on our site, Hole19 is not liable for any loss, claim, expense, damage or cost that you may incur as a result of the provision of any tee time by the golf courses listed on our site, or any other services provided by those golf courses, except to the extent caused by our negligence, fraud or fraudulent misrepresentation or by any other matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
We are not liable for any changes to your tee times or cancellations by the golf course as a result of any event or circumstance beyond the reasonable control of the golf club or course such as severe weather or other unusual or unforeseeable causes.
We take all reasonable care to ensure our website is secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing our website.
Any complaints regarding the service should be addressed to the course. We advise you to make any complaints at the time the problem occurs in order to give the course an opportunity to rectify the situation. Delay in making a complaint may reduce your chances of receiving any compensation.

10. PRIVACY AND INFORMATION SECURITY POLICY

All the personally identifying information (“PII”) you share with us is subject to our privacy and information security policy (www.hole19golf.com/terms).
When making a booking through our platform you consent and authorize us to share any PII with the golf course, as they might need to get in touch with you, regarding your reservation.
